Conflicts of interest and disclosure of fees
Our Conflict of Interest and Transparent Disclosure of Fees Policy is drawn up under the General Code of Conduct for Authorised Financial Services Providers and Representatives (FAIS Act 37 of 2002, Board Notice 58 of 2010). In summary:
- We avoid conflicts of interest where we can. Where a conflict cannot be avoided, or may be perceived, we manage it and disclose it so that you can decide whether it affects the service you receive.
- Our key individual is responsible for the policy. It is approved by the FSP's controlling body, reviewed annually and forms part of every employee's contract and induction training.
- Gifts and other benefits must be declared to the key individual before they are accepted. Benefits that could bias our services, or that the Code does not permit, are refused. Non-cash incentives and benefits are recorded in a register that is updated at least monthly and monitored by the compliance officer.
- You may inspect the register on request; we provide a copy within 7 days of a written request.
- All fees and any other remuneration are disclosed up front, in a written agreement that sets out the services, the fees and the period, and are then reported in periodic statements (at least annually). Any fee-sharing in the value chain is disclosed. Our current fund fees are on each strategy page.
The full policy is available on request from info@effectuscapital.co.za.
Complaints
Please send your complaint in writing to aviraag@effectuscapital.co.za, and keep proof of delivery. Our Complaints Procedure works as follows:
- We record your complaint in our complaints register on the day we receive it and acknowledge receipt.
- Our key individual allocates it to an appropriately skilled and trained person.
- We investigate and aim to reply in writing within 7 working days, and no later than 6 weeks after we received it. We will tell you about any delay.
- If you are not satisfied with our response, you may refer the complaint to the owner of the business, who may amend or confirm the outcome. If a Board or management committee decision is needed, we will tell you when it will be made.
- If you are still not satisfied, you may refer the complaint to the Ombud for Financial Services Providers (FAIS Ombud) within six months, in line with the FAIS Act and its rules, or take other steps on legal advice. The FAIS Ombud: info@faisombud.co.za, 0860 663 247.
If we have not replied within these periods, contact aviraag@effectuscapital.co.za. Where a complaint concerns something outside our control, we forward it to the party concerned.
